Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") form a legally binding agreement between you and SKINNA ("we", "us", "our") governing your access to and use of the SKINNA mobile application and skinna.xyz website (together, the "Service").

By creating an account, downloading, or using SKINNA, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

If we become aware that an account belongs to someone under 16, we reserve the right to suspend or terminate that account.

If you are using SKINNA on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Description of the service

SKINNA is a mobile application that uses artificial intelligence to analyse photographs you provide and generate:

• A "SKINNA Score" and related sub-scores across categories such as skin health, hair, grooming, style, and presence.
• Personalised, general-purpose suggestions related to grooming, skincare, hairstyling, and personal style.
• Progress tracking over time based on repeated scans.

SKINNA offers both a free tier (with usage limits) and paid subscription tiers offering expanded features, as described in the app.

4. AI-generated content and disclaimer

You acknowledge and agree that:

• The AI analysis is based on a photograph and general patterns, and may not be accurate, complete, or appropriate for your individual circumstances.
• SKINNA does not diagnose, treat, cure, or prevent any medical condition, including skin conditions, dermatological issues, or mental health concerns.
• Recommendations regarding skincare, grooming products, or routines are general suggestions, not professional advice, and you should consult a qualified dermatologist, physician, or other professional before making decisions about your health, skincare routine, or use of any product, especially if you have sensitive skin, allergies, or existing medical conditions.
• SKINNA does not recommend, endorse, or provide guidance on cosmetic surgery, injectables, prescription treatments, or any medical procedures, and you should disregard any such suggestion if generated in error.
• Scores and feedback are intended to be positive and motivational. They are not an objective measure of attractiveness, worth, or any scientific metric, and should not be relied upon as such.

If you are experiencing distress related to your appearance, body image, or mental health, we encourage you to speak with a qualified healthcare professional or counsellor. SKINNA is not a substitute for professional support.

5. Accounts

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us promptly of any unauthorised use of your account.
• You may delete your account at any time via Profile → Privacy → "Delete all my data". This action is permanent and irreversible.

6. Subscriptions, billing, and cancellation

6.1 Free and paid tiers

SKINNA offers a free tier with limited features (including a limited number of scans) and one or more paid subscription tiers offering additional features, as described within the app at the time of purchase.

6.2 Billing

Paid subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Pricing, currency, and billing frequency (monthly or yearly) will be displayed before purchase and may vary by region.

6.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your payment method will be charged for renewal through your app store account.

6.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period; you will retain access to paid features until then. We do not provide refunds for partial billing periods, except where required by law or app store policy.

6.5 Promotional and introductory offers

From time to time, SKINNA may offer promotional pricing (such as discounted first-year plans for early adopters). Such offers are subject to specific terms disclosed at the time of the offer, including eligibility, duration, and renewal pricing after the promotional period ends.

6.6 Price changes

We may change subscription prices from time to time. Any price changes will be communicated to you in advance, and changes will apply to subsequent billing periods following such notice. Continued use of a paid subscription after a price change constitutes acceptance of the new price.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
• Upload photographs of any person without that person's knowledge and consent, including images of minors other than yourself (if you are a minor using the Service in compliance with our eligibility requirements).
• Attempt to reverse-engineer, decompile, disassemble, or otherwise discover the source code or underlying algorithms of the Service.
• Use automated means (bots, scrapers) to access the Service or extract data from it.
• Interfere with, disrupt, or attempt to gain unauthorised access to the Service, its servers, or networks.
• Use the Service to harass, abuse, or harm another person, including using SKINNA's outputs to mock, body-shame, or bully others.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Circumvent or attempt to circumvent any usage limits, paywalls, or wellbeing safeguards within the Service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating accounts.

8. Intellectual property

The Service, including its design, text, graphics, logos, icons, the "SKINNA" name and branding, software, and the compilation of all content, is owned by SKINNA or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the SKINNA app on your personal devices for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or its content without our prior written consent.

9. Your content

"Your Content" means the photographs and any other information you submit to the Service.

• You retain all ownership rights to Your Content.
• You grant us a limited licence to process Your Content solely for the purpose of providing the Service to you (i.e., generating your analysis), as described in our Privacy Policy.
• You represent and warrant that you have the right to submit Your Content, and that doing so does not violate any third party's rights or any applicable law.
• As described in our Privacy Policy, your photographs are processed in real time and are not stored by us after analysis.

10. Third-party links and services

The Service may contain links to third-party websites, products, or services (for example, "recommended products" or "watch how-to" links to external retailers or video platforms). We do not control and are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of such third-party sites is at your own risk and subject to their own terms.

SKINNA may receive a commission if you make a purchase through certain affiliate links. This does not affect the price you pay.

11. Disclaimers of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the Service (including any AI-generated score, insight, or recommendation) will be accurate, reliable, or meet your expectations.
• Any errors in the Service will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKINNA AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $20 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or fraud.

13. Indemnification

You agree to indemnify, defend, and hold harmless SKINNA and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in conduct harmful to other users or to SKINNA, or if required to do so by law.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including Sections 8, 11, 12, 13, and 15) will survive.

15. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions, unless otherwise required by mandatory consumer protection laws applicable in your jurisdiction of residence.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue the matter through the courts of competent jurisdiction located in India, subject to any mandatory rights you may have to bring proceedings in your country of residence under applicable consumer protection law.

16. Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the app or other reasonable means before the changes take effect. Your continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms.

17. General provisions

• Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and SKINNA regarding the Service.
• Severability: if any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• No waiver: our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: you may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• App store terms: your use of the Service is also subject to the applicable terms of the Apple App Store or Google Play Store through which you downloaded the app.
